TANGLIN RUGBY CLUB - PITCH USE TERMS & CONDITIONS

1. DEFINITIONS

"Club" refers to Tanglin Rugby Club, its contractors, management, members, officers, staff, and volunteers.

"Block Booking" means a minimum number of 4 Sessions or 1-month period.

"Booking" means a confirmed reservation of the Pitch for a specified date and time.

"Fees" means the hire charges payable for use of the Pitch.

"Pitch" means the grass pitch and its run-off areas.

"Premises" means the (a) Pitch and (b) the property at State Land Lot 02385L (PT) of TS 18 at Carlisle Road, Singapore, also known at Tanglin Rugby Club, 100A Norfolk Road, 219833.

"Session" means the period allocated under a Booking or Block Booking.

"User" means any individual, team, club, school or organisation using the Pitch, including external hirers.

2. PERMITTED USE

2.1. The Premises must only be used for sporting or community uses approved in writing by the Club and in compliance with the Club's Pitch Operations Manual and Practices.

2.2. The Premises must not be used for activities likely to damage the Pitch playing surface, non-sporting events, vehicles, structures or heavy equipment, commercial activities, alcohol sales or events involving amplified sound.

3. BOOKINGS AND FEES

3.1. All use of the Pitch is subject to a Blocked Booking or a Booking and payment of the applicable Fees in advance.

3.2. For Users with Block Bookings longer than a 3-month period, the Fee is payable in advance by quarter.

3.3. Fees are as advised by the Club from time to time, are payable in advance unless otherwise agreed in writing and are exclusive of GST unless stated otherwise.

3.4. The Club may refuse access where Fees have not been paid in full.

4. CANCELLATION AND CREDITS

4.1. Cancellation by the User. Cancellations must be notified in writing. (a) Cancellation 7 days or more before the Session: a credit; (b) Cancellation less than 7 days before the Session: no credit. (c) Non-attendance: no credit.

4.2. Clause 4.1 does not apply to Block Bookings. Block Bookings are deemed non-cancellable and Sessions within a Block Booking are forfeited if cancelled.

4.3. Cancellation by the Club. The Club may cancel or suspend a Booking where: (a) weather or ground conditions make the Pitch unsafe or risk damage; (b) maintenance or regulatory requirements apply; or (c) safety concerns arise.

4.4. Where the Club cancels a Booking, fees paid will be credited at the Club's discretion. The Club is not liable for any losses incurred by the User.

5. WEATHER OR LIGHTNING AFFECTED SESSIONS - CREDITS

5.1. The Pitch is a natural grass surface and weather conditions may affect usability.

5.2. A Session may be deemed a "Weather-Affected Session" where, in the Club's reasonable opinion the Pitch is unsafe or continued use risks damage to the Pitch.

5.3. Where a Session is declared a Weather-Affected Session by the Club, the Session may be suspended or cancelled and the User will be entitled to a credit for a future booking of equivalent value.

5.4. No credit applies where the User elects not to use the Pitch despite it being declared playable; or the Session is more than 50% partially used by time.

5.5. Credits are valid for 6 months from the original booking date and are non-transferable and not redeemable for cash. Credits may be used at available times according to the Pitch's availability and in consultation with the Club.

5.6. A Session may be deemed a "Lightning-Affected Session" where the lightning warning system is activated. Where a Session is declared a Lightning-Affected Session, the Session may be suspended or cancelled. No credit applies to a Lightning-Affected Session.

5.7. Any decision in relation to a Weather-Affected Session is at the Club's sole discretion and its decision is final.

6. ACCESS AND USE

6.1. Access is limited strictly to the booked Session.

6.2. The User shall not sub-let or other assign the Session to any other party.

6.3. Users must vacate the Premises promptly at the end of the Session and comply with all Club instructions, on-site rules, signage and safety directions.

7. PITCH CONDITION AND RISK

7.1. The Pitch is a natural grass surface and conditions may vary.

7.2. Use of the Pitch is at the User's own risk, including risks arising from: (a) weather; (b) lightning; (c) ground hardness or softness; and (d) uneven or worn surfaces.

7.3. The User is responsible for collecting, siting and returning any flags and poles to the Pitch attendant at the beginning and end of their Session. For hire of sports other than rugby, the equipment should be assembled and sited on the pitch by the User under the direction of the Pitch attendant and must not cause damage to the Pitch.

7.4. The Club's decision on Pitch safety or suitability is final.

8. USER OBLIGATIONS

Users must: (a) use the Premises with reasonable care; (b) ensure participants wear appropriate footwear on the Pitch; (c) supervise all minors at all times; (d) leave the Premises clean and free of rubbish; (e) NOT smoke, vape, use PMDs, allow pets, consume food on the Premises or its surrounding areas; (f) immediately report to the Club damage or safety issues relating to the Premises; (g) not do anything on the Premises which in the Club's opinion may cause a nuisance or annoyance to or interfere with the quiet enjoyment or comfort of the adjoining or neighbouring properties; and (h) comply with all applicable laws and sporting regulations.

9. SAFETY AND MEDICAL RESPONSIBILITY

9.1. The User is solely responsible for ensuring that all participants are medically fit to participate and are appropriately trained and supervised.

9.2. The Club does not provide medical or first-aid services unless expressly agreed in writing.

10. DAMAGE TO THE PREMISES AND ITS SURROUNDS

10.1. The User is responsible for any damage caused during the Session.

10.2. The User must not use the Premises or its surrounds in any way or take any action that causes, or may cause damages to the surroundings, structures and to the reputation of the Club.

10.3. The Club may recover the reasonable costs of repair or reinstatement from the User.

11. INSURANCE

11.1. The User must maintain, at its own cost (a) public liability insurance with adequate coverage; and (b) player accident insurance (where applicable) for any claims arising out of or in relation to the participants' use of the Premises.

11.2. The Club may require evidence of insurance prior to use and the Club shall not be liable to the User for any failure by the User to procure its own insurance.

12. ASSUMPTION OF RISK AND WAIVER

12.1. Sports and use of the Premises involve inherent risks of injury, including serious injury.

12.2. To the fullest extent permitted by Singapore law, the User (a) acknowledges and accepts all risks associated with use of the Premises; and (b) voluntarily assumes responsibility for those risks.

12.3. Nothing in these Terms excludes liability for (a) death or personal injury caused by the Club's negligence; or (b) any liability that cannot lawfully be excluded under the Unfair Contract Terms Act 1977.

13. LIMITATION OF LIABILITY

13.1. Subject to Clause 12.3, the Club is not liable for (a) personal injury; (b) loss, damage or theft of property; or (c) economic or consequential loss, arising from use of the Premises.

13.2. The Club's total liability (if any) shall not exceed the Fees paid for the relevant Booking (and in the case of a Block Booking, the pro-rated amount for the actual Booking session).

14. INDEMNITY

The User indemnifies and holds harmless the Club from any and all claims, losses, liabilities, costs and expenses (including but not limited to, legal fees) arising directly or indirectly from use of the Premises or breach of these Terms by the User or participants.

15. BEHAVIOUR AND CONDUCT

15.1. Users must behave respectfully at all times.

15.2. Users must not use the Premises to store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any third parties, political organisations etc.

15.3. The Club may in its sole discretion suspend or permanently prohibit access for unsafe, reputationally damaging, abusive or inappropriate conduct.

16. FORCE MAJEURE

The Club is not liable for failure to provide access due to events beyond its reasonable control, including weather, government action or emergencies.

17. TERMINATION

The Club may immediately terminate access for breach of these Terms, non-payment of Fees, or where continued use poses a safety or reputational risk, in its sole discretion.

18. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of Singapore. The courts of Singapore have exclusive jurisdiction.

19. GENERAL

19.1. These Terms constitute the entire agreement relating to use of the Premises.

19.2. If any provision is unenforceable, the remainder remains effective.

19.3. The Club may amend these Terms from time to time, without prior notice and at its sole discretion.

20. ACKNOWLEDGEMENT

By booking or using the Pitch, the User confirms acceptance of these Terms.
